payroll services

Payroll Services in Italy for Foreign Employers

For foreign groups and founders hiring in Italy

An Italian payroll in order: the employer decided and registered, an enrolled labour consultant engaged, every date on one calendar.

  • Formalities by the employer or an enrolled professional (Art. 1 L. 12/1979)
  • Employer registration can ride on the company filing
  • Hiring notice by the day before the start
  • F24 payment by the 16th

Payslips come last; the employer and its registrations come first.

Payroll that starts with the employer

From Milan, FormaItalia prepares the employer side of an Italian payroll for a foreign group or founder: the employer, its INPS and INAIL registrations, an enrolled consulente del lavoro (labour consultant) and the calendar. The formalities themselves stay with the employer or the enrolled professional (Art. 1 L. 12/1979), as part of Italian accounting and compliance.

The first decision is who the employer will be. The same Comunicazione Unica (the single company filing) that forms an Italian company can carry the INPS employee registration and the INAIL insurance position (Registro delle Imprese), so the employer route is settled before the formation filing.

What's included

What we coordinate, and what we do not.

The employer decision, mapped

Subsidiary, branch, posting, seconded manager or agency work, each with its article and consequences. The choice stays yours.

Employer registrations in the formation filing

INPS and INAIL positions carried by the Comunicazione Unica, now filed through DIRE, or requested later online.

The enrolled professional engaged

Their delegation entered in the INPS "Deleghe" section, with access through form SC65 and SPID, CIE or CNS.

The first hire, in order

Written terms, the UniLav hiring notice, the INAIL notice and the pension-fund choice, each by its term.

The calendar kept

The payroll book, the monthly F24, the true-up, the Certificazione Unica, the modello 770 and the TFR tax.

The TFR test

The yearly accrual of the trattamento di fine rapporto (severance accrual) and the INPS Treasury Fund headcount test.

The DURC when it is asked for

The contribution good-standing certificate for tenders, subsidies and building works, valid 120 days (INPS).

Performed by others, not by us

Computing pay, the payroll book, payslips, INPS declarations, the CU and the 770 stay with the employer or the enrolled professional (Art. 1 L. 12/1979).

Who the employer will be

Each route rests on its own article. A subsidiary can be formed, or one of our ready-made Italian companies taken over and its INPS employer position requested later.

Five employer routes; the choice is settled in a conversation. With a branch or a posting the foreign company employs; its other registrations: our VAT registration for foreign companies service.

Problems we solve

The rule behind each problem, then how it is handled.

A director abroad with no Italian digital identity

INPS lists SPID, CIE 3.0 or CNS; the sources read print no other credential. The enrolled professional's explicit delegation carries the INPS work.

An employer-of-record offer on the table

Agency work needs an agency authorised under D.Lgs. 276/2003 (Art. 30(1) D.Lgs. 81/2015). We ask the provider for that authorisation; no verdict on the product.

A provider abroad offering to run the Italian payroll

The statute exempts EU-qualified providers and lets only small and artisan firms, and firms over 250 staff without an in-house structure, use data-processing centres, always under enrolled assistance (Art. 1 L. 12/1979). We map the offer against that line.

A founder who is also the paid director

35.03% in the Gestione Separata in 2026 for a director with no other compulsory cover (24% where insured elsewhere or a pensioner), two thirds on the company (Circolare INPS 8/2026). The fee's place in year one: what a tax adviser decides before the first year ends.

A date missed

Payroll-book fines reach EUR 6,000 (Art. 39 D.L. 112/2008); a late or wrong CU costs EUR 100 (Art. 4 D.P.R. 322/1998). We keep one calendar with the enrolled professional.

Is an employer-of-record offer or a provider abroad already on the table?

We test the offer against the agency-work definition and the reserved line before anyone signs; no verdict is promised.

Why work with us

  • Silvia Brivio

Regulatory and Founder Mobility Lead, Milan: hiring staff from abroad, with payroll run by an enrolled consulente del lavoro.

FormaItalia holds none of the protected titles (consulente del lavoro, dottore commercialista); we coordinate, and sign, file or transmit nothing reserved.

From our practice

, a worked example (not a client case):** a foreign parent forms an S.r.l. for one hire. The INPS and INAIL positions ride on the Comunicazione Unica; UniLav goes the day before the start; the first payroll book is due by the following month's end, the first F24 by the 16th.

Frequently asked questions

Do you run our Italian payroll?

No. Payroll formalities for employees are performed by the employer itself or its own staff, or by an enrolled consulente del lavoro, lawyer or dottore commercialista (Art. 1 L. 12/1979). We coordinate the enrolled professional, the employer registrations and the calendar, and we sign, file or transmit nothing that the law reserves.

Can a foreign payroll company that is not enrolled in Italy run an Italian payroll?

The statute exempts providers qualified under their own EU state's law who work in Italy under the free provision of services. Only small and artisan firms, and firms over 250 staff without in-house structures, may use data-processing centres, always under enrolled assistance (Art. 1 L. 12/1979). It names no provider qualified only outside the EU; no conclusion follows.

Do we need an Italian company before payroll can run in Italy?

An employer must exist. An Italian subsidiary, or the foreign company's own branch (the branch is the parent itself, Art. 2508 c.c.), registers with INPS and INAIL. For a temporary assignment the foreign employer can instead post its own staff under notification to the Ministry of Labour. Which route fits is settled in a conversation with you.

Is an employer of record the same as outsourced payroll?

Italian statute does not use the term. Art. 30(1) D.Lgs. 81/2015 defines agency work: an agency authorised under D.Lgs. 276/2003 places its own employees at a user's disposal, and the user directs and controls them for the whole assignment. Before relying on an employer-of-record offer, ask the provider which authorisation it holds.

How much does payroll coordination cost?

Our fees are quoted on request once the scope is known: the employer route, the headcount, whether the formation filing carries the employer registrations, and how the enrolled professional is engaged. The state's own charges, meaning withholdings, contributions and penalties, are separate and are listed on this page with their source. Pricing on request.

Our director lives abroad and has no Italian digital identity. Can the company still register as an employer?

INPS access needs enablement on form SC65 and SPID at level 2 or 3, CIE 3.0 or CNS; the sources read print no other credential. An enrolled professional acting on the employer's explicit delegation can file instead. The form of a delegation signed abroad is not settled in the sources read, so it is checked case by case.

How does a new company become an employer with INPS and INAIL?

When the business starts and hires at the same time, through the Comunicazione Unica that forms the company. When hiring comes later, through that filing or the INPS online procedure, and in any case by the 16th of the month after the month the contributions concern. The ordinary term for INPS's decision is 30 days under L. 241/1990.

What must be done before the first employee starts?

The hiring notice (UniLav) reaches the employment service by the day before the start (Art. 9-bis D.L. 510/1996). The written terms come before work starts; a copy of the UniLav notice meets that duty, the missing items follow within seven days and some within one month. The INAIL notice follows at the start or within five days.

What do the monthly and annual calendars of an Italian employer consist of?

Monthly, the payroll book is completed by the following month's end and contributions and withholdings are paid on the F24 by the 16th. Each year, as in force in 2026, the true-up falls by 28 February, the Certificazione Unica by 16 March and the modello 770 between 15 April and 31 October. The UniEmens date is not stated here.

What does the employer withhold from pay?

The employer withholds IRPEF on account at each payment, at the 2026 brackets of 23% up to EUR 28,000, 33% to EUR 50,000 and 43% above, after the employee's deductions, together with the worker's share of contributions. The year-end true-up falls by 28 February or on termination (Art. 23 D.P.R. 600/1973, printed to 31 December 2026).

What is the TFR, and does the employer pay it to INPS?

The TFR accrues yearly as pay divided by 13.5, revalued each year (Art. 2120 of the Civil Code). In 2026 and 2027 it goes monthly to the INPS Treasury Fund, unless sent to a pension fund, when last year's average headcount was 60 or more, or in a start year that year's reaches 50; otherwise it stays a company liability.

What happens if the payroll book is missing or wrong?

Not setting up and keeping the payroll book is fined EUR 500 to 2,500. Missing or untrue entries that change pay, contributions or tax are fined from EUR 150 up to EUR 6,000, depending on the headcount and the period (Art. 39 D.L. 112/2008). A late, missing or wrong Certificazione Unica costs EUR 100 each.

Can a group send its own employee to Italy without an Italian payroll?

A posting undertaking notifies the Ministry of Labour, keeps Italian records during the posting and two years after, and names an Italian contact (Art. 10 D.Lgs. 136/2016). Inside the EU the sending State's social-security law covers a posting expected to last up to 24 months that replaces no other person. Whether it covers non-EU undertakings is open; nothing is promised.

What does a paid company director cost in contributions?

In 2026 a paid director with no other compulsory cover pays into the INPS Gestione Separata at 35.03% in all, or 24% where insured elsewhere or a pensioner. Two thirds fall on the company and one third on the director; the company pays the whole amount on the F24 by the 16th of the month after the fee is paid.

Who sets the pay levels of an Italian employee?

The applicable national collective agreement (CCNL) sets the levels and the pay. There is no statutory national minimum wage for the private sector: the Civil Code leaves pay to the collective agreement first and only otherwise to a judge (Art. 2099). The written terms given to the worker must name the agreement and its code.

Plan the Italian payroll before the first hire

The plan covers the employer route, the INPS and INAIL registrations, the enrolled professional and the calendar.
