elective residence visa
Elective Residence Visa for Italy

The New York consulate asks for a registered lease or deed, Los Angeles for a signed lease under Italian rules or a registered deed, so the dwelling sets the start date.
The elective residence visa (visto per residenza elettiva) is a national long-stay (type D) visa under the decree of 11 May 2011, Annex A point 13, for a non-EU citizen who will settle in Italy without any work. It needs a documented dwelling and stable means not below three times the annual Table A amount; the permit follows entry.
What is the elective residence visa?
The visto per residenza elettiva ("elective residency" on the consulates' pages) is one of the 21 visa types in Art. 1(1) of the interministerial decree of 11 May 2011 (Gazzetta Ufficiale, Serie Generale n. 280 of 1 December 2011): a national type D visa, valid for more than 90 days.
Annex A point 13 sets its purpose: a foreigner who intends to settle in Italy and can maintain themselves without any work activity. It is not a work visa or an investment route; a founder who will run a company in Italy is on the residence route for a founder who moves with the company.
The New York consulate issues it only to applicants planning to move permanently. The application goes to the consulate competent for the place of residence, and the visa is issued within 90 days of the request unless the Consolidated Immigration Act (TUI, D.Lgs. 286/1998) or the regulation provide otherwise (Art. 5 D.P.R. 394/1999): the regulation's term, not a consulate's promise.
The decree's preamble limits a visa-free stay to 90 days and excludes paid activity from it; our reading is that settling needs this type D visa, obtained before entry.
What are the requirements for the elective residence visa?
The decree of 11 May 2011, Annex A point 13 sets three tests (a dwelling, means and no work) and a rule for the family. Each consulate then publishes its own list. The New York consulate may ask for further documents and states that a complete file does not guarantee the visa.
| Test | Decree of 11 May 2011, Annex A point 13 | New York consulate | Los Angeles consulate |
|---|---|---|---|
| Dwelling | Adequate and documented guarantees of a dwelling to elect as residence | Purchase or lease for the whole period, in the applicant's name, registered with the Agenzia delle Entrate, shown in original | Signed rental agreement under Italian rental rules, or a deed with proof of registration; no multiple bookings for houses or hotels, no third-party hospitality |
| Quality of the means | Ample, autonomous, stable and regular, with continuity reasonably presumable | A guarantee of resources in the applicant's own name | A documented and detailed guarantee of substantial and stable private income |
| Amount | Not below three times the annual amount of Table A; no euro figure | Typically around 31,000 euros per person, for family applications (the consulate's guidance) | No euro figure |
| Admitted sources | Annuities and pensions, real estate, ownership of stable economic-commercial activities, other sources other than employment | Private income (pension or annuity), properties, stable economic and commercial activities | Pensions, property rental income, business activities |
| Work | None: a person able to maintain themselves without any work activity | The visa allows no work activity | Income from work is ineligible; no work |
| Family | Cohabiting spouse, minor children and adult cohabiting dependent children: a similar visa if the finances are adequate for them too | Each family applicant shows sufficient resources | Certified civil-status certificates for the accompanying family |

What is the income requirement for the elective residence visa?
Annex A point 13 asks for resources (mezzi di sussistenza, means of subsistence) not lower than three times the annual amount of Table A, annexed to the Interior Minister's directive of 1 March 2000; the decree prints no euro amount. The resources must be ample, autonomous, stable and regular, with their continuity reasonably presumable.
The Foreign Ministry's page on the subsistence-means table states that Table A is valid also for this visa (it cites the decree as n. 850 del 2011).
The New York consulate states that, for family applications, each applicant must demonstrate sufficient financial resources, typically around 31,000 euros per person: one consulate's guidance, not the decree's text. Los Angeles prints no euro amount and asks for a documented guarantee of substantial and stable private income.
Our arithmetic, not an official figure. Table A, for one participant and a stay over 20 days, prints a fixed EUR 206.58 plus EUR 27.89 per person per day (Foreign Ministry page, read on 9 October 2026). Over 365 days, with the fixed quota counted once: EUR 206.58 + EUR 27.89 x 365 = EUR 10,386.43; x 3 = EUR 31,159.29 (with 366 days, (EUR 206.58 + EUR 27.89 x 366) x 3 = EUR 31,242.96).
Neither figure is a threshold set by the decree, and whether the one-participant column applies to each family member is open.

What two consulates print
New York
typically around 31,000 euros per person, for family applications (guidance)
Los Angeles

Neither figure is a threshold set by the decree.
Which income counts, and can it come from a business you own?
The decree admits substantial annuities (cospicue rendite: pensions, life annuities), real estate, the ownership of stable economic-commercial activities (stabili attività economico-commerciali) or sources other than employment (Annex A point 13). The list excludes only employment, but the purpose clause bars any work, and both consulates refuse income from work.
Pensions and social security. Pensions are a listed source. New York asks for official letters from banks, financial consultants, institutions and US Social Security, plus the last two years of income tax returns, in the applicant's own name; Los Angeles asks for similar letters, private pension institutions included, and two years of returns.
A business you own. Ownership of stable economic-commercial activities is an admitted source; Los Angeles names business activities and property rental income. Our reading: income received as an owner, such as dividends or profit shares, can qualify, while pay for running the business cannot.

Can you work or run your company on an elective residence visa?
The visa has one bar, work. Four situations a company owner meets, each with its legal anchor:
No work of any kind
Annex A point 13 admits a person who maintains themselves without any work activity, and both consulates say the visa allows no work. It is not a route to start or run a business.
Holding quotas or shares
The Civil Code sets no residence or nationality condition for a director of an S.r.l. or S.p.A. (Arts. 2380-bis, 2383 and 2475 c.c.). An S.p.A. may appoint non-members; in an S.r.l., management goes to members unless the deed provides otherwise. For a non-EU national, the notary checks the reciprocity condition set by the preliminary provisions of the Civil Code. Our reading: subject to that, company law does not stop a holder owning quotas or shares.
Managing or directing a company
Art. 26(2) TUI files forming a company and taking a company office under self-employment. Our reading: managing is work. No official text we read says whether a holder may sit as director, attend or chair a board, or sign.
A foreign holding directed from Italy
A foreign company controlling an Italian one is presumed resident in Italy if residents make up most of its board; effective management in Italy also makes it resident (Art. 73 of the income tax code, TUIR, as in force in 2026). Our reading: it bites when the person directing it moves.
What housing proof does the consulate accept?
The decree asks for adequate and documented guarantees of a dwelling to be elected as residence (abitazione da eleggere a residenza). New York wants a purchase or lease contract for the entire period, in the applicant's name, registered with the Agenzia delle Entrate (the tax authority) and shown in original.
A lease there must be a Contratto di Locazione ad Uso Abitativo (a residential lease, the consulate's term) with proof that the landlord registered it. The Los Angeles consulate accepts a signed rental agreement under Italian rules or a registered deed of a livable home, and refuses multiple bookings for houses or hotels and third-party offers of hospitality.
A deed is housing proof and real estate is an admitted source, but a property purchase is not an investor-visa category (Art. 26-bis(1) TUI lists government securities, equity of a company or fund, and a philanthropic donation). New York needs the registered contract at filing, so the dwelling sets the start date of the file.

How do you apply for the elective residence visa from abroad?
The order the sources impose; a term appears only where a statute or the regulation gives one.
Settle the route and the structure first
No work intended; who manages any company you own; which income counts as means; whether you direct a foreign holding. These are questions of corporate structuring in Italy, answered before anything is signed.
Secure the dwelling
The decree asks for documented guarantees of a dwelling. New York asks for a purchase or lease for the whole period, in the applicant's name, registered with the Agenzia delle Entrate and shown in original; Los Angeles accepts a lease signed under Italian rules or a deed with proof of registration.
Assemble the means file
Compare the means with three times the annual Table A amount. Both the New York and the Los Angeles pages ask for letters from banks, institutions and Social Security, plus the last two years of tax returns.
Write the letter and check the passport
Both pages ask for a letter giving the reasons for the move; the passport must be valid three months beyond the planned stay (New York) or the visa (Los Angeles).
Attend the consulate
The one competent for your place of residence. Both pages have the type D form signed there, in person, and Los Angeles fingerprints national-visa applicants from 11 January 2025. Family members apply on the same terms.
Consular assessment
More documents may be requested, and a complete file does not guarantee the visa (New York). The visa is issued within 90 days of the request, unless otherwise provided (Art. 5(8) D.P.R. 394/1999).
Before you travel
Arrange health cover valid in Italy or plan the health-service enrolment (Art. 34(3) TUI); then enter Italy and request the permit within eight working days.
Which documents do the New York and Los Angeles consulates list?
The two lists as read, both written for US applicants (our reading); other consulates may ask for more, and no UK list was read.
- Form and photograph, on both pages: the national visa application form for a type D visa, signed at the consulate in person, and a recent photograph.
- Means, on both pages: official letters from banks, financial institutions and consultants and from US Social Security, plus the last two years of income tax returns, in the applicant's own name; the Los Angeles page adds private pension institutions.
- Passport: the New York page asks for validity three months over the planned stay; the Los Angeles page, three months beyond the validity of the requested visa.
- Dwelling: the New York page asks for a purchase or lease for the whole period, in the applicant's name, registered with the Agenzia delle Entrate and presented in original; the Los Angeles page accepts a signed rental agreement under Italian rental rules, or a deed with proof of registration.
- Letter: the New York page asks for a letter explaining the reasons for the move; the Los Angeles page asks for a letter giving the reason, the length of stay, the place of residence in Italy and the accompanying persons.
- Family: the Los Angeles page asks for certified civil-status certificates for the accompanying family; the New York page asks each family applicant to show sufficient resources.
- Residence and travel: the Los Angeles page asks every applicant for proof of residence in its district and a one-way ticket reservation; the New York page asks non-US citizens for proof of residence.
- Foreign public documents: the Foreign Ministry's general rule is legalisation or apostille plus an Italian translation declared conforming; neither list says whether it applies to this file.
Keeping a company while you move to Italy? Settle who owns it and who manages it before the move.
What happens after you enter Italy?
The residence permit (permesso di soggiorno) is requested from the questore, head of the provincial police headquarters (questura), within eight working days of entry (Art. 5(2) TUI). It is issued for the activities the entry visa provides for (Art. 5(2) TUI), and for a permit not issued for work its duration is the one the entry visa provides (Art. 5(3) TUI).
No source we read states the visa's validity or the permit's length for elective residence. The questura issues, renews or converts a permit within 90 days of the application (Art. 5(9) TUI), a term that applies from 22 May 2026 under D.Lgs. 83/2026.
The permit then carries its conditions: it is revoked when the requirements for entry and stay are missing or lapse (Art. 5(5) TUI). Our reading: the dwelling, the means and the absence of work must hold for as long as the permit runs.

State charges only, each with its source and year; our own fees are not on this page. The contribution band depends on the permit's length, which no source we read states.

|---|---|---|
| Revenue stamp | EUR 16.00 | Polizia di Stato, how, where and how much |

Do you need health insurance?
At the visa stage, Annex A point 13 names no health policy, while point 2 (the short-stay business visa) lists one, so the decree asks for a policy where it means to. Neither the New York nor the Los Angeles list names one; other consulates may.
Once resident, a lawfully resident foreigner outside the compulsory categories must insure against illness, accident and maternity with a policy valid in Italy, or enrol in the national health service, which also covers dependent family (Art. 34(3) TUI, text in force from 1 January 2024).
The enrolment contribution is a percentage of the previous year's income, not below EUR 2,000 a year (Art. 34(3) TUI). Our reading: elective residence is not a compulsory category, so the duty applies; the article sets no date for it.
Can the permit be renewed, and does it lead to permanent residence?
Renewal is requested from the questore at least 90 days before expiry, subject to a check of the conditions for the issue, and the renewed permit is not longer than the first (Art. 5(4) TUI, applying from 22 May 2026 under D.Lgs. 83/2026).
The permit is revoked or refused when the requirements for entry and stay lapse (Art. 5(5) TUI). Our reading: the dwelling, the means and the absence of work are re-checked at every renewal, so the conditions are carried for the whole stay, not checked once.
For the long term, a person who has held a valid permit for at least five years, with an income not below the annual assegno sociale (the social allowance), may request the EU long-term residence permit. It is issued within 90 days of the request and is valid ten years (Art. 9 TUI).
Our reading: Art. 9(3) TUI does not exclude this permit by name; whether the questura treats it as a short-duration permit is open.
How does elective residence compare with the other routes to live in Italy?
The routes differ on three things: the right to work, the position against the annual entry quotas of Art. 3(4) TUI, and the money test. The table gives each condition with its article and concludes nothing.
The investor route has its own page, golden visa Italy. A person who will be hired by an Italian company is on another route again: a work visa for a non-EU employee.
| Route | Right to work | Position against the Art. 3(4) TUI quotas | Money test | Permit length where sourced |
|---|---|---|---|---|
| Elective residence (decree, Annex A point 13) | No work | Our reading: not a work entry, so the work quotas do not bite; no source says so in terms | Three times the annual Table A amount | Not stated by any source read |
| Investor (Art. 26-bis TUI) | Yes: the rights of the Art. 26 self-employment permit | Outside | EUR 2,000,000 in government securities; EUR 500,000 in equity of a company or venture-capital fund formed and operating in Italy; EUR 250,000 in an innovative start-up; or a EUR 1,000,000 donation; two years' holding for securities and equity | Covered on the golden-visa page |
| Self-employment (Art. 26 TUI) | Yes: self-employed work, forming a company or taking a company office | Inside (Art. 26(5) TUI) | More than three times the capitalised annual amount of the monthly assegno sociale (Annex A point 7.I.1); company-office case: a company active at least three years, no attestation of the financial parameters | Not stated |
| Italia Startup Visa | Yes, as self-employment through the innovative start-up | Inside (Art. 26(5) TUI) | A fund of not less than EUR 50,000 dedicated to the start-up (the Chicago consulate's checklist) | Not stated |
| Digital nomad (Art. 27(1)(q-bis) TUI) | Remote work | Outside the entries authorised within the quotas (Art. 27(1) TUI) | Not stated on this page | Not longer than one year |

The start-up route is set out in the startup visa guide, and remote work from Italy in the guide to the digital nomad visa Italy.
What does the move do to your taxes?
A person is resident if, for most of the tax period, counting part-days, they have residence, domicile or presence in Italy (Art. 2(2) TUIR, as in force in 2026), and a resident is taxed on all income held, wherever produced (Art. 3(1) TUIR). Our reading: the permit alone does not decide residence.
The pensions, rents and owner's income that qualify for the visa then sit in worldwide income; rates and credits are in the guide to income tax for a resident foreigner.
Two options for people who move, by their conditions only. Art. 24-bis TUIR offers a person not resident for nine of the preceding ten tax periods a substitute tax on foreign-source income of EUR 300,000 per tax period, and EUR 50,000 per extended family member, for transfers from 1 January 2026, after a favourable reply to a ruling request.
Art. 24-ter TUIR sets a 7 per cent substitute tax for holders of foreign pensions who move to a municipality of at most 30,000 inhabitants in listed southern regions or earthquake areas, not resident in the preceding five tax periods. Neither option is said to fit any reader.
These TUIR articles are printed valid to 31 December 2026; D.Lgs. 117/2026, in force 4 July 2026, replaces the TUIR numbering from 2027, and this guide is re-read in January 2027.
What changes for a UK citizen?
A UK national has been a third-country national since 1 January 2021 (Agenzia delle Entrate, Brexit FAQ), so every condition on this page applies as written, at the consulate competent for the place of residence. Our reading: a visa-free stay does not cover settling.
No UK consulate's list was read, so no UK-specific document, address, fee or processing time is stated, nor whether UK nationals are on the Annex II visa-free list. The competent consulate's own page is the place to check.
From our practice: a company owner who plans to settle in Italy
A worked example, built from the rules on this page, not a client case. A non-EU founder owns an Italian S.r.l. through a foreign holding, sits on the holding's board and plans to live in Italy on a pension and dividends.
Before the move, who directs each company is settled (Art. 26(2) TUI; Art. 73 TUIR, as in force in 2026; whether a holder may be a director is open). The income is compared with three times Table A, a lease is registered, the consulate is attended in person, and the permit is requested within eight working days of entry.
On such a file we map who owns and who directs each company; the applicant lodges the visa application.

Frequently asked questions
What is the elective residence visa?
The elective residence visa (visto per residenza elettiva) is a national long-stay visa of type D, valid for more than 90 days, and one of the 21 visa types of the decree of 11 May 2011. It is for a foreigner who intends to settle in Italy and can maintain themselves without carrying out any work activity.
Can US citizens get residency in Italy?
A US citizen who wants to settle in Italy for more than 90 days applies for a national long-stay visa at the Italian consulate competent for their place of residence, then requests a residence permit after arrival. Elective residence is the route for living on income that is not from work.
What are the requirements, and is it difficult to qualify?
The decree sets three tests: documented guarantees of a dwelling; ample, stable and regular means of at least three times the annual Table A amount; and no work. Each consulate adds its own document list. The New York consulate may ask for more documents and says a complete file does not guarantee the visa.
What is the income requirement in euros?
The decree sets a rule, not a euro figure: means not lower than three times the annual amount of Table A of the Interior Minister's directive of 1 March 2000. The New York consulate's guidance is typically around 31,000 euros per person; Los Angeles prints no figure. Any computed amount is our arithmetic, not a threshold.
Can I live in Italy on my social security?
Pensions are an admitted source of means under the decree, and the New York and Los Angeles consulates both accept official letters from US Social Security as proof, together with the last two years of tax returns. Whether a given pension is enough is measured against three times the annual Table A amount.
Does the income have to be passive, or can it come from a business I own?
The decree admits pensions and life annuities, real estate, the ownership of stable economic-commercial activities and sources other than employment, and both consulates refuse income from work. Our reading: income received as an owner, such as dividends, can qualify, while pay for running the business cannot.
Can I work, start a business or run my company on this visa?
No work of any kind is allowed. Italian law files forming a company and taking a company office under self-employment, so our reading is that managing is work, and no official text we read says whether a holder may be a director. The decree's company-office route is the self-employment visa, for a company active at least three years.
Can a non-resident own shares in an Italian company without any visa?
The Civil Code sets no residence or nationality condition for a director of an S.r.l. or S.p.A.; an S.p.A. may appoint non-members, an S.r.l. where its deed provides. For a non-EU national, the notary checks the reciprocity condition of the Civil Code's preliminary provisions. Our reading: otherwise, company law does not stop someone abroad owning quotas or shares.
What housing proof is needed, and does buying a home count?
New York asks for a purchase or lease contract for the whole period, in the applicant's name, registered with the Agenzia delle Entrate and shown in original. Los Angeles accepts a signed rental agreement or a registered deed, not multiple house or hotel bookings or third-party hospitality. A deed counts as housing proof; buying property is not an investor-visa route.
Do I need health insurance?
The decree names no health policy for this visa, and neither the New York nor the Los Angeles list, as read, asks for one; other consulates may. Once resident, Art. 34(3) TUI requires a policy valid in Italy or enrolment in the national health service, with an enrolment contribution of at least EUR 2,000 a year.
Where is the application form and where do I apply?
At the Italian consulate competent for your place of residence. The form is the national visa application form for type D visas, completed and signed in person at the consulate. The New York and Los Angeles consulates publish the form on their own websites with their own document lists; the competent consulate's page is the one to check.
How do I get a resident permit in Italy, and what does the state charge?
After entering on the visa, request the permit from the questore within eight working days; the questura decides within 90 days of the application. State charges include a EUR 16.00 revenue stamp, EUR 30.46 for the electronic permit, EUR 30.00 for the post-office kit and a contribution of EUR 40.00 or EUR 50.00 by permit length.
Can a US citizen live in Italy permanently?
Renewal is requested at least 90 days before expiry, and each renewal re-checks the conditions of the issue. After at least five years on a valid permit, with an income not below the annual assegno sociale, a person may request the EU long-term residence permit, issued within 90 days and valid for ten years.
Can my family come?
The decree lets the cohabiting spouse, minor children and adult cohabiting dependent children receive a similar visa, on condition that the finances are judged adequate for them too. The New York consulate's guidance for family applications is that each applicant shows sufficient resources, typically around 31,000 euros per person.
I am a UK citizen: is anything different?
A UK national has been a third-country national since 1 January 2021, so the same decree, the same tests and the same permit rules apply, and the application goes to the consulate competent for the place of residence.
